Kinema Fitness Privacy Policy

Kinema Fitness, Inc. (“Kinema,” “we,” “us,” or “our“) respects your privacy and is committed to handling personal information responsibly. This Privacy Policy explains how we collect, use, disclose, and otherwise process information through the public-facing Kinema website located at kinemafitness.com and related online services that link to this Privacy Policy, including Kinema’s virtual wellness platform to the extent described below (collectively, the “Site“).

This Privacy Policy applies to information collected through the Site, including information submitted through our Contact Us form, career-related email submissions, our internship application hosted through Jotform, analytics tools used on the Site, and limited information that may be processed in connection with participation in Kinema’s virtual wellness platform. This Privacy Policy does not apply to third-party websites, applications, platforms, or services that may be linked from or made available through the Site, including Jotform, Mindbody, or other third-party tools, which are governed by their own terms and privacy policies.

1. Information We Collect

We may collect the following categories of information through the Site:

2. How We Collect Information

We collect information in a few different ways:

A. Information You Provide Directly

You may provide information directly to us when you:

submit an inquiry through our Contact Us form;
email us, including through our careers email address;
submit an internship application through Jotform;
communicate with us about our services;
participate in virtual wellness programming and choose to interact through chat, comments, feedback tools, or similar features; or
appear on camera or audio during a live or recorded session.

B. Information Collected Automatically

We and our service providers may automatically collect certain technical and usage information when you use the Site, including through cookies and analytics technologies such as Google Analytics.

C. Information from Third Parties

We may receive information from third-party service providers or platforms that support our operations, such as website hosting providers, analytics providers, Jotform, or other tools used to facilitate Site functionality or communications. We may also receive limited information from third-party platforms used in connection with our services, such as Mindbody, where applicable.

3. How We Use Information

We may use the information we collect for the following purposes:

to operate, maintain, and improve the Site and our services;
to respond to inquiries, requests, and communications;
to provide information about Kinema and our offerings;
to process and review job and internship applications;
to administer and support virtual wellness programming;
to facilitate communications, participation, and user interactions in live or recorded sessions;
to monitor Site usage, performance, and trends;
to analyze and improve user experience and Site functionality;
to maintain the security and integrity of the Site;
to comply with legal obligations and enforce our rights; and
for other legitimate business purposes consistent with this Privacy Policy.

4. Contact Forms and Communications

If you contact us through the Site, we may collect the information you choose to provide, such as your name, email address, phone number, company name, and the contents of your message. We use this information to respond to your inquiry, communicate with you, and maintain business records related to your request.

5. Careers and Internship Applications

Our Site may allow you to submit information related to career opportunities in two ways:

by sending resumes and cover letters to careers@kinemafitness.com; and
by submitting an internship application through Jotform.

If you apply for a position or internship, we may collect and process information such as your name, contact information, resume, cover letter, education, work history, qualifications, and any other information you choose to provide. Career and internship submissions are received and reviewed by our internship director and other relevant hiring personnel. We use this information to evaluate applicants, communicate about opportunities, and manage recruiting and hiring activities.

Applicant information is generally retained for approximately one year, unless a longer period is required or permitted by law or reasonably necessary for our legitimate business purposes.

Please note that Jotform is a third-party platform. Information submitted through Jotform is also subject to Jotform’s own terms, privacy policies, and practices, and Kinema is not responsible for Jotform’s privacy or security practices.

6. Virtual Wellness Platform

Kinema offers a virtual wellness platform that is hosted by Kinema and separate from the main website. Based on current operations:

users do not create accounts or profiles specifically for the virtual wellness platform;
Kinema does not use the platform to collect account registration information or payment information;
access to the platform is password-protected and is not tied to individual user accounts; and
users may interact with trainers or other users through platform features.

Although Kinema does not require account creation for the virtual wellness platform, we may still process information that you voluntarily provide or make available through your participation, including:

chat messages, comments, or feedback;
information shared during live classes, workshops, or wellness programming;
audio, video, or your likeness if you appear on camera or speak during a session; and
recordings of live classes or workshops, where applicable. Where sessions are recorded, we provide notice within the virtual wellness platform that the session may be recorded, and any such recordings are used only within the platform.

If you do not want your image, voice, comments, or other content to be visible or included in a live or recorded session, please use caution before participating in interactive features or enabling camera/audio functions.

Because access is password-protected rather than gated by an individual registration process, anyone who obtains the password, including minors under 18, may be able to access and participate in the platform. Parents and legal guardians should supervise any participation by minors, as described further in Section 11 below.

Kinema maintains site-specific waivers for each of its sites, which may apply to your participation in programming at or through that location.

7. Cookies and Google Analytics

The Site uses cookies and similar technologies to support functionality and better understand how users interact with the Site.

We use Google Analytics to help us analyze Site traffic and usage. Google Analytics may collect information such as your IP address, browser type, device information, pages visited, time spent on pages, and referring URLs. Google Analytics uses cookies and similar technologies to generate reports and insights about Site usage. We use Google Analytics only for these purposes and do not use other advertising or remarketing tools, such as Meta Pixel, LinkedIn Insight Tag, or Google Ads remarketing, on the Site.

You can learn more about how Google uses data collected through websites and apps, and you may be able to control certain analytics preferences through your browser settings or available opt-out tools provided by Google.

If you disable cookies, some parts of the Site may not function as intended.

Do Not Track. Some web browsers offer a “Do Not Track” (DNT) feature that signals to websites you visit that you do not want your online activity tracked. There is currently no consistent industry standard for recognizing or responding to DNT signals, and the Site does not currently respond to DNT signals. Third-party analytics providers, including Google Analytics, may collect information about your use of the Site as described in this Privacy Policy and in their own privacy practices.

8. How We Disclose Information

We do not sell your personal information for money. We may disclose information in the following circumstances:

Service Providers: We may share information with vendors and service providers that perform services for us, such as website hosting, analytics, communications, application processing, or similar support services.
Jotform and Other Third-Party Tools: Information you submit through third-party tools may be processed by those providers in accordance with their own terms and privacy practices, and we are not responsible for their privacy or security practices.
Mindbody and Other Third-Party Service Platforms: Certain fitness center, scheduling, payment, or membership-related services may be provided through third-party platforms such as Mindbody. Gym members create and manage their accounts through Mindbody rather than through the Site. These platforms operate under their own privacy policies and terms, and we are not responsible for their privacy or security practices.
Aggregated or De-Identified Reporting: We may share aggregated or de-identified reporting, such as overall utilization or participation information, with employers, landlords, property managers, or corporate clients. We do not intend for this reporting to identify individual users.
Legal and Safety Reasons: We may disclose information if we believe doing so is necessary to comply with applicable law, respond to legal process, protect our rights or property, investigate suspected misconduct, or protect the safety of Kinema, our users, or others.
Business Transactions: We may disclose information in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar corporate transaction.

9. Retention of Information

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

Retention periods may vary depending on the type of information and the purpose for which it was collected. For example:

inquiry information may be retained as needed to respond to and manage communications;
applicant information is generally retained for approximately one year;
analytics data may be retained in accordance with our analytics settings and business needs; and
information associated with live or recorded virtual wellness programming may be retained as needed for operational, administrative, legal, or business purposes.

10. Third-Party Websites and Platforms

The Site may link to or interact with third-party websites, applications, or platforms, including Jotform, Mindbody, and other third-party services. This Privacy Policy does not govern the privacy, security, or information practices of those third parties. We encourage you to review the privacy policies and terms of any third-party services you use.

11. Children’s Privacy and Minors

The Site, including the virtual wellness platform, is intended for users in the United States and is not directed to children under 13. Kinema does not knowingly collect personal information from children under 13 through the Site or the virtual wellness platform. The password for the virtual wellness platform should not be shared with or used by children under 13.

In some cases, certain services may be made available to minors under 18 at particular locations or in connection with certain programming, and minors under 18 may be able to access the virtual wellness platform if they obtain the applicable password, as it does not use an individual registration process. Where minors participate in virtual or wellness-related programming, parents or legal guardians should supervise participation as appropriate.

If Kinema learns that it has collected personal information from a child under 13, Kinema will take reasonable steps to delete that information. If you believe that a child under 13 has provided personal information through the Site or virtual wellness platform, please contact us at info@kinemafitness.com.

12. Data Security

We use reasonable administrative, technical, and organizational measures designed to help protect personal information processed through the Site. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

Users should also take steps to protect their own information, including using secure devices, protecting passwords, and exercising caution when participating in interactive or recorded online sessions.

13. Your Choices

Depending on how you interact with the Site, you may have certain choices regarding your information:

Contact Information: You may choose not to submit inquiries, resumes, applications, or other information through the Site.
Cookies: You may be able to control cookies through your browser settings.
Google Analytics: You may be able to use available browser settings or opt-out tools to limit certain analytics collection.
Virtual Participation: You may choose whether to participate in interactive features, submit comments or messages, or enable camera/audio in virtual sessions, subject to the functionality of the platform and the nature of the program.

14. U.S. Users

The Site is intended for users located in the United States. If you access the Site from outside the United States, you understand that your information may be processed in the United States or other jurisdictions where our service providers operate.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make changes, we will post the updated version on the Site and revise the Effective Date above. Your continued use of the Site after an updated Privacy Policy is posted means you acknowledge the updated Privacy Policy, to the extent permitted by law.
